$5,000 per claim. A plaintiff may not file a claim over $2,500 more than twice in a calendar year. A plaintiff may file an unlimited number of claims under $2,500.

California Small Claims

Includes certified or registered mail, sheriff or personal service by a process server or other disinterested adult. Proof of Service must be filed with the court at least 5 days prior to the court hearing.

Typically 30 to 70 days after service of summons.

Can be consulted, but prohibited at the hearing.

If the defendant counterclaims for more than $5,000, the counterclaim may be removed to Superior Court at the judge's discretion.

The losing party must appeal for a new trial to the Superior Court within 30 days or waive appeal. If judgment is in favor of defendant or monetary award less that plaintiff requested plaintiff may make a motion to vacate the judgment on the grounds of clerical error or legal mistake.

Equitable relief available. Right to sue may not be transferred. Interpreters available. Small claims advisors are available at no cost. Court may order arbitration. You can file online or use the onsite terminal to fill out and print your complaint.
