Defendant may request that the case be transferred from small claims court to the County Court docket. The transfer must be requested at least 2 days before the hearing and defendant must pay the difference in fees between the small claims court and the regular docket of County Court. By law, plaintiff cannot object to the transfer. After the transfer, either party may be represented by an attorney. A jury trial must be requested at the same time as the transfer request.
Either party may file an appeal for a new trial in District Court within 30 days of judgment. On appeal attorneys are allowed, but no jury trial is permitted.
Equitable relief available. Right to sue may not be transferred. A plaintiff may only file 2 claims per week with a maximum of 10 per year.
