If defendant counterclaim exceeds $1,500 and court approves, case will proceed under formal rules of civil procedure and evidence in District Court.

Only defendant may file an appeal for a new trial in Superior Court. However, if plaintiff is a consumer and defendant a manufacturer/seller whose failure to file an answer results in default, defendant forfeits the right to appeal.

No personal injury or property damage cases. Consumers may bring actions for contracts (including sale of personal property) and for damages resulting from a retail sale or delivery service.
